Bio:
Scott Payne was born and raised in Maple Ridge. Scott attended Simon Fraser University, completing a Bachelor of Arts in History in 2011. He then attended law school at the University of British Columbia.
During Scott’s time at the University of British Columbia, he assisted aspiring real estate licensees as a Law Tutor at the Sauder School of Business. He also volunteered with the Law Students’ Legal Advice Program, providing free legal services to low-income clients.
Scott completed law school in the spring of 2015 and joined CBM Lawyers that summer as an articled student. He was called to the bar in spring 2016.
Scott specializes in:
- Estate litigation disputes, including claims to vary or invalidate wills as well as claims to recover assets belonging to estates;
- Employment law; and
- Committeeship
Scott enjoys reading history books and classics, jogging around the Lower Mainland and playing squash. However, Scott’s main source of cardio is chasing after his young son, James.
Scott also volunteers as a director of the Langley Community Music School
Work Highlights:
- Fornwald v. Page, 2025 BCSC 532 – represented a plaintiff whose common-law spouse of 37 years made no provision for her in his will. The Court granted a variation of the will, providing the plaintiff with approximately $1,350,000.00 of an estate worth $1,700,000.00.
- Rathor v. Robinson, 2024 BCSC 1165 – represented a plaintiff who was the beneficiary of an estate. The Court granted judgment confirming that assets the executor claimed to own personally in fact belonged to the estate.
- Getz v Getz, 2023 BCSC 1687 – represented a plaintiff in a dispute over shares in a corporation. The Court granted a preservation order preventing the defendant from transferring or selling the shares.
- Lefebvre v. Gisborne Holdings Ltd., 2023 BCSC 2221 – represented a plaintiff whose employment was terminated in the course of a fixed-term employment agreement. The Court determined that the plaintiff was entitled to severance pay equivalent to the entire remaining balance of the fixed employment term.
- Sazynick v. Skwarchuk, 2021 BCSC 443 – co-counsel for the plaintiff whose brother had misappropriated significant assets from the parties’ parents, including three real estate properties. The Court ordered repayment of these assets to the parents’ estates, along with special costs against the defendant.
- North Shore Law LLP v. Cassidy, 2020 BCSC 1658 – represented a defendant who was sued by a law firm for debts accrued by her former spouse. The Court dismissed the claim for want of prosecution.
- Franklin v. Cooper, 2016 BCCA 447 – co-counsel for the plaintiff in an appeal of a decision confirming that a home transferred to the defendant was in fact held in trust for the estate of the parties’ mother. The Court of Appeal dismissed the appeal and affirmed the original decision.
