BC Court of Appeal awards CBM client interest in home worth $1.6 million

Gene Fraser and Scott Payne recently appeared as counsel before the BC Court of Appeal and succeeded in defending a judgment following a BC Supreme Court trial.

The case concerned the ownership of a valuable Vancouver home that a widowed mother transferred to herself and one of her daughters as joint owners. After the mother passed away, the home passed to the daughter and consequently did not form part of the mother’s estate. As a result, the remaining beneficiaries of the mother’s estate, including CBM’s client, were deprived of the value of the home, which had been the most significant asset owned by the mother.

At trial in the BC Supreme Court, Gene Fraser successfully argued that the home was held on trust for the deceased mother and therefore formed part of the mother’s estate, to be distributed among her children and grandchildren as beneficiaries. With the assistance of Scott Payne, Gene Fraser convinced the BC Court of Appeal to uphold the trial decision. As a result, CBM’s client went from having no legal interest in the home to being entitled to a third of the home’s value, estimated as approximately $1.6 million.

Good Times at the 2016 Langley Good Time Cruise-In

Our Personal Injury Law Team was delighted to attend the annual Langley Good Times Cruise-In on September 10th.

The Cruise-In is an annual event run by a not-for-profit society that brings car enthusiasts together for a spectacular mixed car show with all net proceeds going to local charities. Started in 1997 by a committed group of City of Langley merchants and business people, the event has grown in popularity with participants and spectators from across Canada and the United States.

It was a gorgeous day to be out and about in our community and our crew was on hand to answer questions about the firm and to hand out free cold bottles of water for participants and spectators.

Great Turn Out and Great Fund Raising Effort

The Langley Advance reported that the show attracted between 80,000 and 100,000 people this year and that the proceeds for local charities are expected to meet or exceed last year’s effort of $83,000.  The Cruise-In is just one of the many events hosted and run by dedicated local volunteers that make us so very proud to serve this community.

This year all recipients of funds raised included:

BC Supreme Court awards Campbell Burton McMullan LLP client $1.1M settlement from ICBC

Our own Rick McMullan recently received some press coverage after representing a Langley man who was involved in a series of car accidents in 2008. The 33-year-old man was awarded $1.1 million by Justice Williams in the New Westminster Supreme Court who concluded that the accidents had rendered the man incapable of returning to work as a carpenter.

A more detailed summary of the case is available here.
